Can I withdraw from TSP with a POA?

My husband, of 10.4 yrs, and I have grown apart and decided to divorce. I've consulted with a lawyer, already. I don't have the money to pay for the divorce cuz I'm a student. I asked him to pay for it, but he will not give me the money. So, my plan is to withdraw from his TSP. (I'll tell him I'm doing it) Can I do that? I do have POA. I need money also to get me started and to move on. I thought it would be better to ask for the TSP then to take his pension. (he did work so hard for it and its not fair that I do that to him) I only hope that when he retires from the military, he will think of our daughter!
